Coimisiún na Meán (“the Commission”) is required to establish and to maintain a Register of Media Service Providers (“the Register”) pursuant to the Broadcasting Act 2009 as amended (“the 2009 Act”).
Date last updated: 17 December 2024
Media service providers who are under the jurisdiction of the State and provide audiovisual on-demand media services are subject to registration. The Commission has also been conferred with statutory enforcement powers in respect of the registration process which includes, pursuant to section 46F, the power to issue directions to media service providers to take a specified action where it appears to the Commission that a media service provider has failed to comply with its notification obligations.
The information included in the Register in respect of each media service provider is mandated by Rules published by the Commission. The Commission published its first Register on 30 November 2023 and its second Register was published on 2 January 2024. The Commission is today, 17 December 2024 publishing a revised Register that includes two new media service providers. The entries in this Register are based upon the notifications submitted to, and decisions made by, the Commission on or before 12 December 2024. The revised Register also reflects changes to the information related to media service providers and/or their services as notified to the Commission in accordance with section 46C of the 2009 Act.
The Register will be subject to changes and additions on a continuing basis. Pursuant to section 46C of the 2009 Act, a registered media service provider must notify the Commission of any change to the information recorded in the Register relating to either the provider or the services provided by the provider. In accordance with section 46E, the Commission is required to, from time to time as it considers appropriate, review each entry in the Register and amend an entry if, following this review, it is satisfied that the provider to which an entry relates is not subject to registration or the information included in the Register is incorrect. Before making any amendments, the Commission will consult with the provider (if it is practicable to do so) and may request further information from the provider for the purposes of deciding whether to make the amendment. The Commission will give the provider a statement in writing of any such amendment.
Removal of entries
Pursuant to section 46G of the 2009 Act, if the Commission removes from the Register an entry relating to a media service provider or an audiovisual on-demand media service, the Commission shall enter into the Register a statement to that effect and the reasons for that removal.
