Video-Sharing Platform Services Designation Decision Framework

We developed a Decision Framework to inform providers of online services of our assessment and decision-making process to determine whether a named service meets the defining criteria of a “video-sharing platform service” and the provider of such service is under the jurisdiction of Ireland.

Notice of Designation of Video-Sharing Platform Services as a Category of Relevant Online Services

Coimisiún na Meán (the “Commission”), in exercise of the powers and duties conferred on it by section 139E and section 139G of the Broadcasting 2009 Act as amended (“Act”), and after consultation with the persons specified in section 139H of the Act hereby designates as a category of relevant online services to which online safety codes may be applied the video-sharing platform services the provider of which is under the jurisdiction of the State.

Effective date

Pursuant to Section 139H(3) of the Act, this designation becomes effective at the end of the period of 28 days after the date of the Commission’s publication of this notice on its website.  The date of publication of this Notice is 14 August 2023.    

The effective date of this designation is 11 September 2023.  

Notice of Designation of Named Video-Sharing Platform Services

Coimisiún na Meán (the “Commission”), in exercise of the powers and duties conferred on it by Section 139E and Section 139G(2) of the Broadcasting Act 2009 (the “Act”), and after consultation with the service providers pursuant to section 139H of the Act, has designated the services listed below as relevant online services to which online safety codes may be applied because they are video-sharing platform services the provider of which is under the jurisdiction of the State.   

Effective Date 

Pursuant to Section 139H(3)(a) of the Act, this designation took effect upon the Commission giving each service notice of the designation in writing. These dates are noted below.   

Determinations to apply the Online Safety Code

Notice of Determination to Apply the Code to the Category

Coimisiún na Meán (the “Commission”), in exercise of the powers and duties conferred on it by section 139L of the Broadcasting Act 2009 (the “Act”), after consultation with the persons specified in section 139L(4)(b) and (c) of the Act, and having had regard to the matters set out in section 139L(3) of the Act, has determined on 17 October 2024 to apply the online safety code made on 10 October 2024 and known as the “Online Safety Code” to the category of relevant online services being video-sharing platform services the providers of which are under the jurisdiction of the State (the “Category”). Pursuant to Section 139L(2)(b) of the Act, this determination becomes effective at the end of the period of 28 days after the date of publication of notice of the determination on the Commission’s website. The Commission further determines that the deadline for implementation of Part A of the Online Safety Code by providers falling within the Category is 19 November 2024. The Commission further determines that the deadline for implementation of Part B of the Online Safety Code by providers falling within the Category is 21 July 2025.
